Our Core Service

The Malaysian judicial system consists of the subordinate courts (Magistrates Court and Sessions Court) and the superior courts (High Court, Court of Appeal and Federal Court). Claims and applications are litigated before these courts according to their respective jurisdictions that depends upon the subject matter and value of the claims.

We have the experience and skill in conducting civil trials and applications at the Magistrate Courts, Sessions Court and High Court across West Malaysia and representing clients at the appellate hearings before the Court of Appeal and Federal Court.

Over the years we have developed knowledge and experience on practice and procedural issues before the subordinate and superior courts and we are able to handle proceedings before these courts on short notice or on urgent basis. We also provide services as counsel or co-counsel for solicitors in respect of their clients. We have also developed a network of solicitors across the country to facilitate client’s needs wherever necessary.

Contract, Company and Commercial Disputes

Contract law governs the conduct of parties to a contract and provide remedies to the innocent party in the event of a breach of contract or disagreement over the terms of the contract. There are various types of contracts such as contract for services, contract for goods, agency contracts, financial contracts and indemnity contracts. Company law regulates the administration of the affairs of the company, power and authority of the officers of the company, rights of shareholders, winding-up and liquidation of the company. Commercial law is the body of law that governs trade and businesses such as sale of goods, hire-purchase and consumer transactions.

We have represented clients in disputes arising from breach of contractual terms such as claim for payment for services rendered, goods delivered, defective services and defective goods claim. We have acted in hire purchase claims, winding-up proceedings, company regulatory issues, claims pursuant to breach of loan agreements, construction claims, house buyer’s claim, partnership disputes, and other commercial claims.

Negligence Claims

Negligence law establishes the duty of individuals and entities to uphold a reasonable standard of care when fulfilling obligations in society. A failure to maintain this standard results in liability, requiring the responsible party to compensate the affected individual for losses sustained due to the breach. Negligence can be broadly categorized into general negligence, which applies to ordinary individuals, and professional negligence, which concerns those with specialized skills who fail to meet the required standard in their field of expertise, trade, or service. The principles of negligence apply universally.

Employees are granted security of tenure and cannot be terminated without just cause or reasonable excuse. Additionally, an employer cannot unilaterally alter the terms of an employment contract to the employee’s detriment. We represent both employers and employees in Industrial Court proceedings and various employment-related disputes. We act for employees challenging unfair dismissals or cases of constructive dismissal before the Industrial Court. Our experience includes handling dismissals due to misconduct such as insubordination, unauthorized absence, theft, harassment, fraud, and abuse of authority. We also manage constructive dismissal claims arising from corporate restructuring, involuntary resignations, and workforce reductions. Additionally, we frequently represent clients in judicial review applications before the High Court challenging Industrial Court rulings.

Strata management law oversees the authority and responsibilities of management corporations and joint management bodies while defining the rights of individual parcel owners and providing legal avenues for resolving conflicts between owners and management entities.
